By accessing, browsing, registering for, downloading, installing, or otherwise using Jumpspree, including without limitation the Jumpspree website, mobile applications, desktop applications, SellerPad, Jumpspree Live, APIs, software, features, tools, messaging systems, livestream functionality, marketplace services, content distribution systems, and all related services and technologies (collectively, the “Platform”), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Use, our Privacy Policy, Selling Fees Policy, Community Guidelines, and any additional policies, notices, disclosures, or legal terms published by Jumpspree from time to time. These Terms constitute a legally binding agreement between you and Jumpspree and apply to all users worldwide, including buyers, sellers, viewers, creators, subscribers, visitors, businesses, organizations, and any person or entity accessing the Platform in any capacity.
If you do not agree to these Terms in their entirety, you may not access or use the Platform.
Jumpspree reserves the right to modify, revise, supplement, or update these Terms at any time in its sole discretion. Material changes may be communicated through email, in-app notification, website notice, or other reasonable means. Your continued use of the Platform following any modification constitutes your acceptance of the revised Terms.
To use the Platform, you must be at least twelve (13) years of age.
Users under the age of thirteen (13) may only use the Platform with verifiable parental or legal guardian consent in accordance with the Children’s Online Privacy Protection Act (“COPPA”) and other applicable child protection laws and regulations.
Users under twelve (13) years of age are strictly prohibited from creating accounts, accessing the Platform, or using any Jumpspree services.
By creating an account or using the Platform, you represent and warrant that:
Jumpspree reserves the right to suspend, restrict, or terminate accounts suspected of violating age restrictions or providing false eligibility information.
You agree to provide accurate, complete, current, and truthful information during account registration and throughout your use of the Platform.
You are solely responsible for maintaining the confidentiality and security of your account credentials, passwords, authentication methods, connected devices, payment methods, and account access. You accept full responsibility for all activities conducted through your account, whether authorized by you or not.
You agree to immediately notify Jumpspree of:
Accounts may not be sold, assigned, transferred, leased, sublicensed, or shared without Jumpspree’s prior written consent. Jumpspree reserves the right to refuse registration, reclaim usernames, restrict account features, or terminate accounts at its sole discretion.
Subject to your compliance with these Terms, Jumpspree grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for lawful personal, social, commercial, marketplace, and content-sharing purposes authorized by Jumpspree.
This license does not transfer ownership of the Platform or any intellectual property rights associated with the Platform.
You may not:
Violation of these Terms may result in immediate suspension or termination of your license and account access.
You retain ownership of the text, photos, videos, livestreams, graphics, listings, comments, usernames, profile information, product descriptions, messages, audio, metadata, and other materials you upload, publish, transmit, distribute, or otherwise make available through the Platform (“User Content”).
By posting or submitting User Content, you grant Jumpspree a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to host, store, reproduce, display, publish, modify, adapt, distribute, promote, market, analyze, translate, create derivative works from, and otherwise use such User Content in connection with operating, improving, advertising, promoting, developing, and providing the Platform across all media formats and distribution channels now known or later developed.
You represent and warrant that:
Jumpspree reserves the right, but not the obligation, to review, moderate, remove, disable, restrict, demonetize, or refuse any User Content at any time and for any reason.
You agree not to use the Platform to engage in unlawful, fraudulent, harmful, deceptive, abusive, or prohibited conduct.
Prohibited conduct includes, without limitation:
Jumpspree maintains a zero-tolerance policy regarding fraud, counterfeit goods, payment abuse, and illegal conduct. Jumpspree may cooperate with payment processors, financial institutions, regulators, intellectual property holders, law enforcement agencies, and government authorities regarding suspected unlawful activity.
Jumpspree provides marketplace technology that allows users to buy, sell, market, promote, and livestream products and services. Jumpspree is not the owner, manufacturer, importer, warehouse operator, distributor, or guarantor of items sold by independent sellers on the Platform unless expressly stated otherwise.
Sellers are solely responsible for:
Sellers may select individual return windows of 7 days, 14 days, or 30 days per listing. Buyers must request returns within the selected return period applicable to the purchased item.
Jumpspree may temporarily withhold payouts to account for:
Transactions processed through Stripe Connect may use direct charge payment structures under which sellers act as the merchant of record for their transactions. Under such structures, sellers may be financially responsible for disputes, refunds, chargebacks, negative balances, unauthorized transactions, and payment liabilities associated with their activity. Jumpspree Live permits eligible sellers to host livestream shopping sessions subject to Platform rules and subscription requirements.
Livestream sellers must comply with all applicable selling rules, shipping requirements, payment policies, livestream standards, and authenticity obligations. Jumpspree reserves the right to suspend, restrict, remove, or terminate livestream privileges at any time.
Payment processing services on Jumpspree are provided by third-party payment processors, including Stripe and Stripe Connect. By using payment services on the Platform, you agree to comply with all applicable Stripe terms, payment processor agreements, banking requirements, financial regulations, and verification obligations. Jumpspree does not independently provide banking services, money transmission services, escrow services, or financial advisory services. Payment processing fees charged by Stripe are non-refundable unless otherwise required by law. Jumpspree does not guarantee uninterrupted access to payment processing systems or financial services integrations.
Jumpspree may require sellers to complete identity verification, Know Your Customer (“KYC”), Know Your Business (“KYB”), tax verification, bank verification, identity authentication, fraud screening, sanctions screening, or enhanced compliance reviews.
Sellers may be required to provide:
Jumpspree reserves the right to delay payouts, restrict listings, require additional documentation, reject onboarding applications, freeze accounts, or terminate selling privileges based on risk analysis, fraud indicators, chargeback activity, authenticity concerns, intellectual property complaints, or regulatory compliance obligations.
Buyers may request returns only within the seller-selected return window associated with the applicable item listing. Once the applicable return window expires, buyers are no longer eligible to request a return or refund through the Platform except where otherwise required by law or deemed necessary during fraud investigations, payment disputes, or regulatory compliance reviews. Buyers may cancel eligible orders within three (3) hours of purchase or before shipment, whichever occurs first. Stripe payment processing fees are generally non-refundable. Jumpspree does not independently guarantee refunds, reimbursement, delivery, authenticity, merchant solvency, seller performance, or transaction outcomes.
Certain Platform features may require paid subscriptions, including Jumpspree More. Subscription benefits may include livestream access, enhanced visibility, profile verification, advanced features, expanded posting capabilities, editing functionality, analytics, and premium tools. Subscriptions automatically renew unless canceled before the applicable renewal date. Jumpspree reserves the right to modify pricing, features, availability, or subscription structures at any time.
All Platform technology, trademarks, logos, branding, software, graphics, interfaces, features, databases, designs, compilations, audiovisual materials, and proprietary content are owned by Jumpspree or its licensors and are protected under intellectual property laws. Except as expressly permitted, users may not copy, reproduce, distribute, exploit, modify, republish, or create derivative works from Platform materials without prior written authorization. All rights not expressly granted are reserved by Jumpspree.
The Platform may integrate with third-party software, APIs, payment processors, analytics providers, social platforms, hosting providers, shipping carriers, verification providers, and external services.
Jumpspree does not control and is not responsible for the accuracy, legality, reliability, availability, security, or performance of third-party services. Your use of third-party services is governed by the applicable third-party terms and policies.
THE PLATFORM IS PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUMPSPREE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, SECURITY, RELIABILITY, AVAILABILITY, OR ERROR-FREE OPERATION.
Jumpspree does not guarantee:
Users assume all risks associated with their use of the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUMPSPREE, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, INVESTORS, LICENSORS, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
THIS LIMITATION INCLUDES DAMAGES RELATED TO:
IN NO EVENT SHALL JUMPSPREE’S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO JUMPSPREE DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Jumpspree and its affiliates, officers, employees, agents, licensors, contractors, successors, and assigns from and against any claims, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including attorneys’ fees, arising from:
Jumpspree reserves the right to suspend, limit, freeze, restrict, demonetize, or permanently terminate accounts or Platform access at any time and for any reason, including suspected fraud, policy violations, abusive conduct, counterfeit sales, excessive disputes, intellectual property complaints, payment abuse, or regulatory concerns. Termination may occur without prior notice where necessary to protect users, payment systems, intellectual property rights, financial partners, or Platform integrity.
Sections relating to intellectual property, liability limitations, indemnification, payment obligations, dispute rights, arbitration, and enforcement shall survive termination.
These Terms shall be governed by and interpreted under the laws of the State of New York, Nassau County without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Nassau County unless arbitration is required by applicable law. To the extent legally permissible, users waive objections based on jurisdiction, venue, or inconvenient forum. EU, UK, and international users may retain rights granted under mandatory local consumer protection laws where applicable.
You represent and warrant that you are not located in, organized under, or ordinarily resident in any country or territory subject to embargoes or sanctions administered by the United States or other applicable authorities. You agree not to use the Platform in violation of export controls, sanctions laws, anti-money laundering laws, or trade restrictions.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Jumpspree may assign, transfer, delegate, or sublicense these Terms and related rights without restriction. Users may not assign or transfer their rights or obligations without prior written consent. These Terms constitute the entire agreement between you and Jumpspree regarding use of the Platform and supersede prior agreements or understandings relating to the subject matter herein.
